Q: We are wanting to void or break our contract with our listing agent. We have signed a contract for a year. We do not work well together. We feel her goals are more for her than for us. She is the realtor on the sale of our home. That is as far as we want to take this relationship. What are our options? (before we contact our attorney).

A:I would suggest that you speak to her honestly about your concerns and give her an opportunity to address them. Be specific about your needs and expectations of her as your agent. Sometimes, if this is not communicated at the beginning of your working relationship, she is probably conducting business in her own way. So talk to her. If you continue to feel that your needs are not being addressed, write a nice letter saying that you appreciate her time and effort, but you think it would be best to end your business relationship and would like to be released from your buyer?s agreement. Offer to pay for any advertisement expenses she may have incurred. This way, you?ve given her an opportunity to work harder to keep your business and you?re being fair if it doesn?t work out. A: Dear Texas Seller,
You should not need to go so far as to have to hire an Attorney. You should be able to go to the Broker of Record in the office where your agent works and tell them you want to cancel the listing and the contract. Only in rare circumstances have I seen that this turns into a big issue. Most of us want good relations with clients, even if our personalities clash (so to speak).
